本利用規約（以下「本規約」）は、BlackFoil（以下「当社」）が提供するモバイルアプリ「FormAI」（以下「本アプリ」）の利用条件を定めるものです。本アプリを利用することで、本規約に同意したものとみなされます。
当社は、本規約に従うことを条件として、お客様に本アプリを個人的かつ非商業的に利用する、譲渡不可・非独占的なライセンスを付与します。
本アプリのフォーム判定およびフィードバックは、一般的なフィットネスのガイドラインに基づく参考情報であり、医療・専門的な指導の代替ではありません。運動には怪我のリスクが伴います。新たに運動を始める前や、健康上の不安がある場合は、医師等の専門家にご相談ください。痛みや違和感を覚えた場合は直ちに中止してください。お客様は自己の責任において本アプリを利用するものとします。
本アプリおよびそのコンテンツ（デザイン、テキスト、ロゴ、ソフトウェアを含む）に関する権利は当社または正当な権利者に帰属します。
本アプリの一部の音声フィードバック（「高品質音声」として表示されるもの）は、Supertone Inc. の Supertonic-3 モデルを用いて端末上で生成される AI 合成音声であり、実在の人物の声ではありません。当該モデルは BigScience Open RAIL-M ライセンスに基づき組み込まれており、ライセンス全文および帰属表示はアプリ内の「設定 → ライセンス」から確認できます。お客様は、本アプリの音声を同ライセンスの利用制限（Attachment A）に反する目的で利用してはなりません。
お客様は、本アプリのリバースエンジニアリング、再配布、法令に違反する利用、その他当社が不適切と判断する行為を行ってはなりません。
本アプリは「現状有姿」で提供されます。当社は、本アプリが特定の目的に適合すること、中断なく動作すること、または判定結果が正確であることを保証しません。
適用法令が許す最大限の範囲で、当社は、本アプリの利用または利用不能から生じるいかなる間接的・付随的・結果的損害についても責任を負いません。
本規約はお客様と当社の間のものであり、Apple は当事者ではありません。本アプリに関する保守・サポートの義務は当社が負います。Apple およびその子会社は本規約の第三受益者であり、本規約に同意したお客様に対して本規約を行使する権利を有します。
当社は本規約を変更することがあります。変更後に本アプリを継続して利用した場合、変更後の規約に同意したものとみなされます。

These Terms of Use ("Terms") govern your use of the mobile application "FormAI" (the "App") provided by BlackFoil ("we," "us"). By using the App, you agree to these Terms.
Subject to these Terms, we grant you a non-transferable, non-exclusive license to use the App for personal, non-commercial purposes.
The form assessments and feedback provided by the App are general informational guidance based on common fitness guidelines and are not a substitute for medical or professional advice. Exercise carries a risk of injury. Consult a physician or qualified professional before starting any new exercise program or if you have health concerns. Stop immediately if you feel pain or discomfort. You use the App at your own risk.
All rights in the App and its content (including design, text, logos, and software) belong to us or our licensors.
Some voice feedback in the App (shown as "premium voices") is AI-generated speech synthesized on your device using the Supertonic-3 model by Supertone Inc.; it is not the voice of a real person. The model is embedded under the BigScience Open RAIL-M license; the full license text and attributions are available in the App under Settings → Licenses. You may not use the App's audio for purposes that violate the use restrictions of that license (Attachment A).
You may not reverse-engineer, redistribute, use the App unlawfully, or otherwise use it in a manner we deem inappropriate.
The App is provided "as is." We do not warrant that it will be fit for a particular purpose, operate without interruption, or that its assessments are accurate.
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the App.
These Terms are between you and us; Apple is not a party. We are solely responsible for maintenance and support of the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
We may modify these Terms. Continued use of the App after changes constitutes acceptance of the revised Terms.
